FullSignaux SASU, Subscriber subscriptions

These Terms of Sale (hereinafter the "Terms of Sale") apply to any subscription to a paid plan on the Next Generation of Traders Service, published by FullSignaux, a SASU (simplified joint-stock company) with capital of 100 euros, registered with the Paris Trade and Companies Register (RCS) under SIREN number 105 866 446, with its registered office at 1 rue Marguerin, 75014 Paris, France. These Terms of Sale supplement the Service's General Terms of Use, to which they refer for any matter not addressed below.
Article 1. Purpose
These Terms of Sale set out the conditions and procedures for subscribing, paying, cancelling, and obtaining refunds applicable to paid subscriptions that give a Subscriber access to the Signals published by Traders listed on the Service.
Article 2. Subscription plans and pricing
The Service offers subscription plans lasting 3, 6, or 12 months, with pricing displayed on the Service before any subscription is made. The monthly price of a subscription may not be lower than 19 euros per month. Prices are shown inclusive of all taxes and may vary depending on the selected Trader and the chosen subscription length.
FullSignaux reserves the right to change its prices at any time, provided that such changes do not apply to subscriptions already taken out before the change takes effect.
Article 3. Payment terms
Subscription payments are made online by credit card, via Stripe Connect, a payment services provider licensed in the European Union. FullSignaux has no access to any of the Subscriber's banking data, which is collected and processed directly by Stripe.
Fixed-term subscriptions (3, 6, or 12 months) are paid according to the terms displayed at the time of subscription (either paid in full at subscription or through instalments, depending on the plan chosen). Subscription payments compensate, through a split between FullSignaux and the relevant Trader, access to the Signals published by that Trader, in accordance with the partnership agreement between FullSignaux and the Trader.
Article 4. Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, any Subscriber who qualifies as a consumer and has subscribed remotely has a period of fourteen (14) days from the date of subscription to exercise their right of withdrawal, without needing to provide a reason or pay any penalty, except for fees corresponding to services already provided.
To exercise this right, the Subscriber must send their request to contact@fullsignaux.com. If the Subscriber has expressly requested access to the Signals immediately upon subscription, before the withdrawal period has expired, they will owe an amount corresponding to the service actually provided up to the date of withdrawal.
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for service contracts that have been fully performed before the end of the withdrawal period and whose performance began with the Subscriber's prior express consent and express waiver of their right of withdrawal.
Article 5. Cancellation
The Subscriber may cancel their subscription at any time from their profile on the Service. Cancellation ends future payments and takes effect at the end of the current subscription period, with no refund for the period already underway, except where the right of withdrawal under Article 4 is validly exercised or as otherwise required by law.
Article 6. Refunds
Except where the right of withdrawal applies, no refund is owed in the event of early cancellation of a fixed-term subscription, unless FullSignaux decides otherwise or applicable mandatory law requires it. In the event of a prolonged unavailability of the Service attributable to FullSignaux, FullSignaux may, at its discretion, grant a credit or a refund proportional to the period of unavailability.
Article 7. Referral program
FullSignaux offers, on an optional basis, two separate referral programs.
Referral between Traders: a Trader who refers a new Trader (the referred person) receives 5% of the amounts actually collected from the subscriptions taken out by the referred person's Subscribers, during the first twelve (12) months following their registration. This remuneration is paid monthly to the referring Trader as the amounts are collected.
Referral between Subscribers (mutual discount): a Subscriber who refers a new Subscriber (the referred person) using a referral code receives no money, but benefits, as does the referred person, from a discount on the price of their own subscription with the same Trader. The rate of this discount and its duration (one or two billing months) are set freely by the Trader, and the program is available only on 3, 6 or 12 month subscriptions. The discount is granted automatically to the referred person on their first subscription, and to the referring Subscriber on their current subscription once that first subscription is paid.
This program does not, under any circumstances, constitute a pyramid or multi-level sales scheme within the meaning of Article L.122-6 of the French Consumer Code: the benefit granted is strictly limited to a single referral level (the direct referrer) and does not depend on any obligation for the referred person to recruit new Subscribers or Traders themselves. No financial contribution is required from the referrer to take part in the program.
Article 8. No guarantee of financial results
FullSignaux and the Traders listed on the Service do not guarantee any financial result, return, or performance. Investing in financial markets carries a risk of capital loss, up to and including total loss of the amounts invested. A Trader's past performance, including that shown on the Proof Wall, is not indicative of future performance. The Subscriber acknowledges that they make their own investment decisions independently and at their own risk.
Article 9. Complaints
Any complaint relating to a subscription may be sent to contact@fullsignaux.com. FullSignaux undertakes to respond within a reasonable time, and no later than thirty (30) days.
Article 10. Consumer mediation
In accordance with Article L.616-1 of the French Consumer Code, any Subscriber who qualifies as a consumer has the right to use a consumer mediator free of charge in the event of a dispute with FullSignaux that has not been resolved amicably.

Article 11. Governing law and jurisdiction
These Terms of Sale are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent court shall be that of the jurisdiction of FullSignaux's registered office, subject to mandatory jurisdiction rules applicable to consumers.
Article 12. Changes to these Terms of Sale
FullSignaux reserves the right to change these Terms of Sale at any time. Subscriptions already in progress remain subject to the Terms of Sale in effect on the day they were taken out, unless a change is required by a change in law or regulation.
