FullSignaux SASU, applicable to the website and the mobile application

These Terms of Use (hereinafter the "Terms of Use") govern access to and use of the website www.fullsignaux.com and the Next Generation of Traders mobile application (hereinafter together the "Service"), published by FullSignaux, a SASU with capital of 100 euros, registered with the Paris Trade and Companies Register under SIREN number 105 866 446, with its registered office at 1 rue Marguerin, 75014 Paris.
Access to the Service implies full and unreserved acceptance of these Terms of Use. If you do not accept all or part of the Terms of Use, you may not access the Service.
Article 1. Definitions and users
1.1. "Service" means the Next Generation of Traders website and mobile application, enabling connections between Traders and Subscribers.
1.2. "Signal" means any recommendation to take a position on a financial instrument published by a Trader on the Service.
1.3. "Proof Wall" means the area of the Service documenting withdrawals of earnings made by members who followed the Signals.
1.4. Categories of users. The Service is accessible to two categories of users:
- Subscribers: any adult natural person (18 years or older) or legal entity wishing to access the Signals published by Traders listed on the Service, through a paid subscription. Access is conditional on acceptance of these Terms of Use, the required identity verification, and payment of the subscription.
- Traders (Signal Leaders): independent professionals or entities that have entered into a partnership agreement with FullSignaux, authorized to publish Signals on the Service after validation of their application and verification of their performance by FullSignaux. Traders act as independent service providers and are neither employees, agents, nor representatives of FullSignaux.
Article 2. Nature of the Service and absence of financial advice
Next Generation of Traders is a technology platform for connecting users and tracking Signals. FullSignaux is not an authorized investment services provider within the meaning of Directive 2014/65/EU (MiFID II) and does not provide any personalized investment advice within the regulatory meaning.
The Subscriber's trading capital remains, at all times, in their personal broker account, subject to the financial regulations applicable to that broker. FullSignaux has no access to Subscribers' trading accounts, open positions, or investment funds.
FullSignaux collects subscription payments through Stripe Connect and pays the compensation due to Traders under the terms of their partnership agreement. This collection is strictly limited to subscription flows and does not, under any circumstances, concern the funds invested by Subscribers on the financial markets.
Investing in financial markets carries a risk of capital loss. A Trader's past performance is not indicative of their future performance. The Subscriber makes their investment decisions independently and remains solely responsible for their choices.
Article 3. Registration and access to the Service
Registration for the Service requires creating a personal account and providing accurate and up-to-date information. The Subscriber guarantees the accuracy of the information provided and undertakes to update it in the event of changes.
FullSignaux may make access to certain features conditional on identity verification (KYC), in particular as part of its obligations to combat money laundering and terrorist financing, as well as its obligations related to payment processing via Stripe Connect.
Every account is strictly personal. The Subscriber undertakes not to disclose their login credentials to a third party and to immediately inform FullSignaux of any unauthorized use of their account.
Article 4. Subscriber obligations
The Subscriber undertakes to:
- use the Service in accordance with its purpose and these Terms of Use,
- not reproduce, distribute, or commercially exploit the Signals without authorization,
- not attempt to circumvent the Service's security or paid-access measures,
- not use the Service for fraudulent purposes or purposes contrary to public order,
- bear sole responsibility for their investment decisions.
Article 5. Trader obligations
The Trader undertakes to publish Signals that faithfully reflect their own trading decisions, to not disseminate any misleading information about their performance, and to comply with the commitments made in the partnership agreement concluded with FullSignaux. FullSignaux reserves the right to suspend or terminate a Trader's access in the event of a breach of these commitments.
Article 6. Termination and access to funds
The Subscriber may cancel their subscription at any time from their profile. Cancellation ends future payments, under the conditions set out in the Terms of Sale.
The Subscriber's trading capital is held exclusively in their personal broker account: FullSignaux has no access to it, whether the subscription is active or cancelled. Withdrawals of funds from the broker account are made directly under the conditions specific to that broker, independently of FullSignaux.
Article 7. Intellectual property
All elements of the Service (trademark, logo, structure, source code, editorial content) are protected by intellectual property law and remain the exclusive property of FullSignaux, with the exception of the Signals published by each Trader, who remains their author, subject to the exploitation license granted to FullSignaux under the partnership agreement.
Article 8. Protection of personal data
The processing of users' personal data is described in the Service's Privacy Policy, accessible from the footer of the site and the application. For any question regarding your data, you may contact contact@fullsignaux.com.
Article 9. Cookies
The Service uses cookies and trackers necessary for its operation (session, authentication, payment) as well as audience measurement cookies, subject to the user's prior consent in accordance with applicable regulations. The procedures for managing these cookies, as well as the means of withdrawing consent at any time, are set out in the Privacy Policy.
Article 10. Limitation of liability
FullSignaux implements reasonable means to ensure the availability and security of the Service, without guaranteeing the absence of interruption, error, or vulnerability. FullSignaux cannot be held liable for investment decisions made by a Subscriber based on a Signal, nor for any resulting financial losses.
Article 11. Term and changes to the Terms of Use
These Terms of Use apply for the entire duration of use of the Service. FullSignaux reserves the right to change these Terms of Use at any time, in particular to adapt them to changes in the Service or in regulations. Users will be informed of any substantial change by notification on the Service, prior to it taking effect.
Article 12. Governing law and jurisdiction
These Terms of Use are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties shall endeavor to seek an amicable solution before any legal action. Failing an amicable agreement, the competent court shall be that of the jurisdiction of FullSignaux's registered office.
Article 13. Consumer mediation
In accordance with Article L.616-1 of the French Consumer Code, any Subscriber who qualifies as a consumer has the right to use a consumer mediator free of charge in the event of a dispute that has not been resolved amicably.
